Second or Third DUI
Skilled Modesto DUI Defense Attorney

harsh penalties for first-time offenders. Those facing a second or subsequent
DUI conviction, however, could be subjected to enhanced consequences that
can impact all areas of their lives.
At the Law Offices of Mark W. Girdner, our experienced Modesto DUI lawyer
is a former prosecutor, giving us an insider understanding of how the
state will build their case against you. When you retain our firm, you

Consequences of Multiple DUI Convictions
In order for a prior DUI conviction to count against you, it must have
occurred in the 10 years prior to the current DUI arrest. For the purpose
of sentencing you, “wet reckless” convictions will also count
as a prior DUI.
The penalties for a second DUI conviction include, but are not limited to:
- Up to 5 years of summary probation
- Up to one year in county jail
- Fines totaling up to $1000
- Mandatory completion of a 18 or 30-month DUI program
- A 2-year suspension of your driver’s license
For a third or subsequent DUI conviction, the consequences will only get
worse. The fines will triple to roughly $3000, your license will be revoked
for three years, and you may spend a minimum of 120 days in county jail
– to name just a few.
